All documentation and contracts to the subcontractor must clearly show that the subcontractor is liable for all loss and damage and must ensure that they have adequate transit cover. If the subcontractor’s claim is rejected by the subcontractor’s Insurer, our policy will step in as a policy of last resort. The existence of this policy may not be disclosed to the subcontractor. After paying a claim, we will then sue that subcontractor in terms of their agreement with the Transport Broker and it is therefore important that the liability issue is made clear.
